Jensen & McComas, LLC (“Jensen & McComas,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect through our website at jensen-mccomas.com (the “Site”) and when you contact us through it, how we use and share that information, how long we keep it, and the rights and choices you have.
The short version
- We collect the personal information you choose to send us (through our contact form, by email or by phone) and use it to respond to you.
- We use Google Analytics to understand how the Site is used, only if you accept analytics cookies. You can change your choice at any time under “Cookie settings” at the bottom of every page.
- We do not sell your personal information, share it for targeted advertising, or use advertising pixels or remarketing tools.
- Questions or requests? Email legal@jensen-mccomas.com or call 443.323.0110.
Scope of This Policy
This policy applies to information collected through the Site and through communications you send us using it. It does not cover information we receive in the course of representing a client. Information about our clients and their matters is protected by our professional obligations of confidentiality, including the Maryland Attorneys’ Rules of Professional Conduct, and by the terms of our engagement agreements.
No Attorney-Client Relationship
The information on the Site is for general information purposes only and is not legal advice. Visiting the Site, sending us a message through the contact form, or emailing or calling us does not create an attorney-client relationship. An attorney-client relationship is formed only when we agree in writing to represent you. Until then, please do not send us confidential or time-sensitive information about a legal matter.
Information We Collect
Information you give us. When you use our contact form, email us or call us, we collect the information you choose to provide, such as your name, email address, phone number and the contents of your message. If you apply for a position with the firm, we collect the information in your résumé, cover letter and any related correspondence.
Payments. Client payments made through our Client Portal are handled by our payment processor, FeeWISE. You enter your payment details on FeeWISE’s site, not ours, and we do not receive or store your full card number. FeeWISE’s handling of your information is governed by its own privacy policy.
Information collected automatically. Like most websites, our hosting and security providers automatically record technical information when you visit, such as your IP address, browser type, device and operating system, the date and time of your visit and the pages requested. We use this information to operate, secure and troubleshoot the Site. If you accept analytics cookies, Google Analytics also collects information about how you use the Site, as described below.
Information we do not seek. We do not knowingly collect sensitive personal information (such as health information, Social Security numbers, financial account details, precise geolocation, or information about racial or ethnic origin, religious beliefs or sexual orientation) through the Site. Please do not include it in a message to us.
Cookies, Google Analytics and Your Choices
Cookies are small text files that a website stores in your browser. Similar technologies, such as your browser’s local storage, work in much the same way. We use them as follows:
- Strictly necessary. The Site remembers your cookie choice in your browser’s local storage, and our hosting and security providers may use technical cookies to protect the Site against attacks and spam. These do not track you across other sites and cannot be switched off without affecting how the Site works.
- Analytics (optional). With your consent, we use Google Analytics 4, provided by Google LLC, to understand how visitors use the Site, for example which pages are viewed, how visitors arrive at the Site, and the type of device and browser used. Google Analytics sets cookies named
_gaand_ga_*, which last up to two years. Google Analytics 4 does not log or store IP addresses. We have not enabled Google’s advertising features, Google Signals or data sharing for advertising, and we do not use Google Analytics data to identify you.
Your choices. Google Analytics does not load until you click “Accept” in our cookie notice, and “Reject” is just as easy. You can change your choice at any time with the “Cookie settings” link at the bottom of every page. If you withdraw consent, we stop analytics and delete the analytics cookies from your browser. We ask again after 180 days, or sooner if we change the tools we use. You can also block or delete cookies in your browser settings, or install the Google Analytics Opt-out Browser Add-on. To learn how Google uses information from sites that use its services, visit How Google uses information from sites or apps that use our services.
Global Privacy Control. If your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out, and analytics cookies stay off unless you choose to turn them on. Because there is no common standard for browser “Do Not Track” signals, we respond to GPC rather than Do Not Track.
How We Use Information
We use personal information to:
- respond to your inquiry, schedule a consultation and communicate with you;
- check for conflicts of interest before we can agree to represent anyone, as our professional rules require;
- consider applications for employment;
- operate, maintain, secure and improve the Site, including preventing spam, fraud and misuse;
- understand how the Site is used, if you consent to analytics; and
- comply with our legal, regulatory and professional obligations, and establish, exercise or defend legal claims.
We do not use your personal information for automated decision-making or profiling that produces legal or similarly significant effects.
How We Share Information
We do not sell personal information, and we do not share it with third parties for cross-context behavioral or targeted advertising. In the past 12 months, we have not sold or shared personal information in those ways. We disclose personal information only as follows:
- Service providers who act on our behalf and under contracts that limit how they may use it: website hosting, security and content delivery (for example Kinsta, Google Cloud and Cloudflare), website analytics (Google Analytics, with your consent), email and IT services, and payment processing (FeeWISE).
- Professional advisers, such as our accountants, insurers and lawyers, where needed for the firm’s operations.
- Legal requirements: when we believe disclosure is required by law, regulation, court order or the rules of professional conduct, or is needed to protect the rights, property or safety of the firm, our clients or others.
- Business changes: in connection with a merger, combination or other transfer of all or part of the firm, subject to our professional obligations.
- With your consent or at your direction.
How Long We Keep Information
We keep personal information only for as long as we need it for the purposes described in this policy, including to meet our legal, regulatory, professional, accounting and insurance requirements. Inquiries that do not lead to an engagement are generally kept for as long as needed to respond and to maintain conflict-of-interest records. Google Analytics data is kept for no more than 14 months, after which Google deletes it. When information is no longer needed, we delete it or make it anonymous.
How We Protect Information
We use reasonable administrative, technical and physical safeguards to protect personal information, including encrypted (HTTPS) connections to the Site and limited access to the information you send us. No website, email or electronic storage is completely secure, so we cannot guarantee absolute security. Email is not always a secure way to send confidential information.
Your Privacy Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information. Some privacy laws apply only to organizations that meet certain size or volume thresholds, or exempt certain information. Even so, we will honor reasonable requests from anyone, wherever they live, to the extent the law and our professional obligations allow.
- Know and access: to confirm whether we process your personal information and to receive the categories and specific pieces of personal information we hold about you, its sources, why we use it and to whom we disclose it.
- Portability: to receive a copy of your personal information in a portable, readily usable format.
- Correction: to have inaccurate personal information corrected.
- Deletion: to have personal information we collected from you deleted, subject to legal exceptions (for example, records we must keep under our professional obligations).
- Opt out: of the sale of personal information, sharing for targeted or cross-context behavioral advertising, and profiling in furtherance of decisions with legal or similarly significant effects. We do not do any of these things.
- Limit the use of sensitive personal information, or withhold consent to its processing. We do not seek sensitive personal information through the Site.
- Withdraw consent at any time, for example to analytics cookies through “Cookie settings”, without affecting processing that took place before.
- Non-discrimination: we will not deny you services, charge you different prices or provide a different quality of service because you exercised your privacy rights.
U.S. State Privacy Laws
These rights are provided by the consumer privacy laws of states including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, and by any other state that grants similar rights. The rights available, and how they apply, differ from state to state.
California Notice at Collection
In the past 12 months, we may have collected the following categories of personal information, as defined by the California Consumer Privacy Act (as amended by the California Privacy Rights Act). In each case the purposes are those described in “How We Use Information”, and the retention period is as described in “How Long We Keep Information”:
- Identifiers, such as name, email address, phone number and IP address. Source: you, and automatically from your device. Disclosed to: service providers.
- Internet or other electronic network activity, such as pages viewed and interactions with the Site. Source: automatically, and through Google Analytics with your consent. Disclosed to: service providers.
- Approximate location derived from an IP address (not precise geolocation). Source: automatically. Disclosed to: service providers.
- Professional or employment-related information, if you apply for a position. Source: you. Disclosed to: service providers.
- Any other information you choose to include in a message to us. Source: you. Disclosed to: service providers.
We have not sold or shared (for cross-context behavioral advertising) any of these categories, and we have no actual knowledge of selling or sharing the personal information of consumers under 16. We do not use or disclose sensitive personal information for purposes that would give rise to a right to limit its use. Under California’s “Shine the Light” law (Civil Code § 1798.83), we do not disclose personal information to third parties for their own direct marketing purposes.
Visitors from the European Economic Area, the United Kingdom and Switzerland
If the GDPR, the UK GDPR or Swiss data protection law applies to you, Jensen & McComas, LLC is the controller of your personal information. We process it on these legal bases: to take steps at your request before entering into a contract, and to perform a contract; our legitimate interests in responding to inquiries and running and securing the Site, which we balance against your rights; your consent, for analytics cookies; and compliance with our legal obligations. In addition to the rights above, you may object to processing based on our legitimate interests, ask us to restrict processing, and lodge a complaint with your local data protection authority. We are based in the United States, so your information is processed there. Where required, we rely on appropriate safeguards for these transfers, such as the European Commission’s Standard Contractual Clauses or our service providers’ certification under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions.
How to Exercise Your Rights
To make a request, email legal@jensen-mccomas.com, call 443.323.0110, or write to us at the address below. Please tell us which right you wish to exercise and how we can reach you. - Verification. To protect your information, we will verify your identity before acting on a request to access, correct or delete it, usually by confirming information we already hold. We will use the information you provide for verification only for that purpose.
- Authorized agents. You may use an authorized agent to make a request on your behalf. We may ask for written proof of the agent’s authority and ask you to verify your identity directly with us.
- Timing. We will respond within the time required by applicable law, generally within 45 days. Where the law allows, we may extend this period once by up to 45 more days, and we will tell you if we do.
- Appeals. If we decline your request, you may appeal by replying to our decision or emailing legal@jensen-mccomas.com with “Privacy Request Appeal” in the subject line. We will respond to your appeal within the time required by law, generally 45 to 60 days. If you are not satisfied with the result, you may contact your state Attorney General.
Children’s Privacy
The Site is intended for adults and is not directed to children under 16. We do not knowingly collect personal information from children under 13 (or under 16 where the law sets a higher age). If you believe a child has sent us personal information, please contact us and we will delete it.
Email Communications
We do not add you to a mailing list because you contacted us through the Site. If you subscribe to firm news or updates, every email will include a way to unsubscribe, and you can also unsubscribe by contacting us.
Links to Other Websites
The Site links to websites and services we do not control, such as our payment processor (FeeWISE), LinkedIn, Facebook and organizations we are affiliated with. Their privacy practices are governed by their own policies, which we encourage you to review.
Accessibility
If you need this policy in a different format, please contact us and we will provide it in a way that works for you.
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will post the revised policy on this page and change the “Last updated” date above. If we make material changes, such as using a new tool that collects personal information, we will give more prominent notice, for example by asking for your cookie choice again.
